Notice for Candidates: Simultaneous Filing Lottery for the 2025 Consolidated Elections

This notice informs candidates running for Mayor, Clerk, and Council Members (Wards 1-9) of the procedure for simultaneous petition filings.

If two or more petitions for the same office are filed at the opening of the filing period (October 21st, 8:30 AM) or in the last hour (October 28th, 4:00–5:00 PM), ballot placement will be determined by lottery. The City Clerk will conduct the lottery using a method approved by the State Board of Elections.

Who is eligible?

Candidates (or their designees) in line at 8:30 AM on October 21, 2024 (eligible for first ballot placement).
Candidates whose petitions are received by mail with the first delivery on the first day are (eligible for first ballot placement).
Candidates whose petitions are received between 4:00 PM and 5:00 PM on October 28, 2024 (eligible for final ballot placement).

Filing Opening Hour

-All people with petitions in line at the time of opening 8:30 am on October 21st are deemed filed during the opening hour.

-All petitions filed by mail that are received after midnight on the first day of filing and in the first mail delivery are deemed filed within the opening hour.

-If 2 or more petitions are received simultaneously, a lottery shall be held to determine ballot order

Filing Closing Hour

-Regardless of our office’s regular closing hours, we must stay open until 5:00 PM on the last day October 28th for filling.

- 2 or more petitions filed within the last hour, for the same office, are deemed filed simultaneously.

- If 2 or more petitions are received simultaneously, a lottery shall be held to determine ballot order.

Lotteries must be conducted:

Within 9 days of the last day to file petitions
With 7 days written notice of the time and place of the lottery
In a manner open to the public
Approved lottery procedures for simultaneous filings can be found in the State Board of Elections Rules and Regulations 26 III. Admin. Code 100. 10, et. Seq.

In order to be eligible for lottery:

First ballot positions are for candidates who were in line at the time that the office opened on the first day to file.

Final ballot positions are for candidates who file between 4:00 PM and 5:00 PM on the final day to file.

A lottery is only necessary if there were more than one candidate for a given position filling simultaneously.

Lottery Approved Method:

The names of all candidates who filed simultaneously for the same office should be listed alphabetically by last name and numbered consecutively, with the number 1 assigned to the candidate who is listed first alphabetically.

All ties will be broken by a single drawing

A number representing each candidate/group of candidates’ alphabetical position in shall be placed in a container

Numbers shall be shaken and mixed in the container, then drawn one at a time

The candidate in the position on the alphabetical list corresponding to the first number drawn shall be certified first, the second candidate certified second, etc.

Last Day to File Objections to Nomination Papers for the Consolidated Primary Election

Last day to file objections to nomination papers of established party and nonpartisan candidates in the office of the local election official or election authority.

November 15, 2024

Notice of Municipality Conducting Primary

Last day for a municipal clerk to certify to the election authority the municipal ordinance providing for the nomination of municipal officers by party primary in municipalities under 5,000 population.

November 25, 2024

Last Day to File Petitions for Public Questions for the Consolidated Primary Election

Last day to file petitions with the local election official for the submission of questions of public policy. Exceptions to this date apply for various binding questions or backdoor referenda, please refer to the authorizing statute for the question to confirm the deadline.

December 4, 2024

Last Day to File Objections to Petitions for Public Questions for the Consolidated Primary Election

Last day to file objections to petitions for the submission of questions of public policy with the local election official. Please note that this date accounts for observing November 28 and 29 as holidays; if the office of the local election official is open for a minimum of 7 hours on November 29, the deadline to file objections in that office will be December 3, 2024.

NOTICE is hereby given that the office of Clerk Stephanie Mendoza, Local Election Official, will be open from 8:30 AM to 5:00 PM, Monday through Friday only, beginning October 21, 2024, through October 28, 2024, for the purpose of accepting candidate petitions or certificates for the 2025 Consolidated Election. If a primary election is necessary, it will be held on February 25, 2025, and the general election will be held on April 1, 2025, for the following offices:

• City Council Members (Wards 1-9)

WITHDRAWAL FROM CANDIDACY

Any candidate who has filed petitions may withdraw their candidacy. The withdrawal must be in writing, signed by the candidate, dated, and notarized. The written withdrawal must be submitted to the same election official who received the original petitions not later than the date for certification of candidates for the ballot. No candidate name withdrawn in accordance with the provisions of the Election Code shall be printed upon the ballots. If the request for withdrawal is received after the date for certification of the candidates for the ballot, then the votes cast for the withdrawn candidate are invalid and shall not be reported by the election authority. (10 ILCS 5/10-7)

Requests for Withdrawal should be submitted using SBE Form P-25.
